Terms of Service

Agreement

These Terms of Service (“Terms”) are a binding agreement between you and Jobcakes LLC(“Jobcakes,” “we,” “us”). By creating an account, accessing, or using Jobcakes (including the web application, APIs, and Chrome extension), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials, activity under your account, and keeping your contact information current. Notify us promptly at support@jobcakes.com if you suspect unauthorized access.

Use of Jobcakes

Jobcakes helps users manage job search workflows, profiles, applications, interviews, resumes, calls, and SMS conversations. Users are responsible for the information they add, upload, send, receive, or generate through the service.

Acceptable use

You agree not to misuse Jobcakes. Prohibited conduct includes, without limitation:

• Violating applicable law, carrier rules, or third-party platform terms.
• Harassment, fraud, impersonation, spam, or bulk unsolicited outreach.
• Uploading malware, probing systems, or interfering with service operation or security.
• Scraping, reverse engineering, or reselling access except as expressly permitted.
• Using AI-generated content without reviewing it for accuracy, legality, and suitability.
• Misrepresenting employment history, credentials, or identity in applications or communications.

We may investigate, suspend, or terminate accounts that violate these Terms or create risk for users, recipients, carriers, or the platform.

Subscriptions and billing

Paid plans (such as Pro and Pro Multi) are billed on a recurring monthly basis unless stated otherwise at checkout. Prices, included profiles, and feature limits are described on our Pricing page and in-product. Taxes may apply where required by law.

Payments are processed through our payment providers (including cryptocurrency checkout where enabled). By subscribing, you authorize recurring charges until you cancel. Cancellation stops future renewals; access generally continues through the end of the paid period unless stated otherwise in-product.

Except where required by law, fees are non-refundable once a billing period has begun. If a payment fails, we may provide a grace period before downgrading or suspending paid features. Profile limits on downgrade may lock excess profiles without deleting your data.

AI and generated content

Jobcakes may provide AI-assisted features. Outputs may be inaccurate, incomplete, or inappropriate for a given role. You are solely responsible for reviewing, editing, and deciding whether to use generated resumes, cover letters, messages, interview answers, or other content.

AI features are provided “as available.” We do not guarantee hiring outcomes, interview success, or employer responses.

Intellectual property

Jobcakes and its branding, software, and documentation are owned by Jobcakes LLC or its licensors and are protected by intellectual property laws. You retain ownership of content you submit. You grant Jobcakes a limited license to host, process, and display your content solely to operate and improve the service as described in our Privacy Policy.

Copyright complaints (DMCA)

If you believe material on Jobcakes infringes your copyright, send a notice to support@jobcakes.com with: (1) identification of the copyrighted work; (2) identification of the material claimed to be infringing and its location; (3) your contact information; (4) a statement of good-faith belief; (5) a statement under penalty of perjury that your notice is accurate and you are authorized to act; and (6) your physical or electronic signature. We may remove or disable access to disputed material and notify the affected user where appropriate.

Phone and SMS Use

Jobcakes phone features are for one-to-one employment-related communication. Users may send and receive messages with recruiters, hiring teams, and companies for job application follow-ups, interview scheduling, interview coordination, and responses to recruiter outreach.

Users may not use Jobcakes for bulk messaging, purchased contact lists, scraped phone lists, third-party lead generation, spam, harassment, fraud, prohibited content, or automated mass marketing campaigns.

SMS Program Terms

Program name: Jobcakes Employment Messaging. Program description: Jobcakes users can send and receive one-to-one SMS messages from their assigned Jobcakes phone number for employment-related communication, including recruiter replies, job application follow-ups, interview scheduling, interview coordination, and related hiring conversations.

Message frequency varies based on user activity and the recipient's employment-related conversation with the Jobcakes user. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

For help, reply HELP or contact support@jobcakes.com. To opt out of future SMS messages from a Jobcakes phone number, reply STOP. After opting out, recipients may reply START to resubscribe where supported.

Consent and Opt-Out

Users must only message recipients when they have a valid reason to communicate in an existing or expected employment-related context. Recipients may reply STOP to stop future SMS messages, START to resubscribe, and HELP for assistance.

Compliance

Users agree to follow applicable laws, carrier rules, Twilio requirements, and Jobcakes policies when using calling and messaging features. Jobcakes may suspend or restrict phone features to protect recipients, users, the platform, or communications providers.

Disclaimers

JOBCAKES IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Jobcakes LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF JOBCAKES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) AMOUNTS YOU PAID TO JOBCAKES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Indemnification

You agree to defend, indemnify, and hold harmless Jobcakes LLCfrom claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your content, your use of Jobcakes, your violation of these Terms, or your violation of any law or third-party right.

Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. You agree that exclusive venue for disputes arising from these Terms or Jobcakes lies in state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction there.

Changes to these Terms

We may update these Terms from time to time. The effective date above shows the latest version. Material changes may be supplemented by in-product notice where appropriate. Continued use after changes become effective constitutes acceptance.

Service Changes

Jobcakes may update, suspend, or discontinue features as needed for reliability, compliance, security, or business reasons.
